Should marriage as defined by the law be the same as marriage as defined by religion?

All this talk about 'marriage being a union between a man and a woman' mostly comes from religious groups (on both sides). Should marriage be defined as such, does it not violate the first clause of the First Amendment, "Congress shall make no law respecting an establishment of religion"?
